AMRN Rehearing Request is Denied
Earlier today, as expected the Federal Circuit denied AMRN's Petition for panel rehearing and en banc review. See the attached ORDER of the court.
This should be the end of the road for AMRN in this litigation and the asserted patents. The question now is when will the first generic announce their launch.
However, as I indicated in my presentation last month to you, I don't think this is the end of the road more generally in terms of litigation between AMRN and the generics. It will be a question of whether AMRN attempts to stop or quickly put a hold on a generic launch using other patents in their portfolio and a new lawsuit, when a generic launch is imminent or occurs. Alternatively, and less likely in my view, AMRN could wait and let a generic launch and let more facts in the generic launch possibly play out to its favor, as the generics have the overhang risk after they launch, that AMRN will file another lawsuit. I will discuss these future possible litigations more in a post in the near future, with more details about which patents AMRN could potentially assert in such a lawsuit.
